Purchase Agreement and Health Guarantee
The following Contract Purchase Agreement is between seller “Hoerter’s Gander Acres” and buyer “__________________________________.” This agreement is made and entered on (Date) __________. The buyer agrees to purchase a Male OR Female from the litter of (Dam) __________________ and (Sire) ___________________ whelped on ____/____/____ for the agreed purchase price of $_________.

A non-refundable deposit of $200.00 is required to place a “hold” on a specific pet. If the pet is not available due to health, wrong gender, or color- 100% of the deposit will be refunded. If the buyer decides to change their mind in regards to the purchase of the pet the deposit is forfeited by the buyer. All pets are sold with limited registration unless otherwise specified by the seller. The seller reserves the rights to terminate the contract at any time prior to the placement of the pet for any reason. This contract is not transferable. The purchase price does not include the cost of shipping, shipping crates, health certificates, or any other costs incurred to ship a pet to a specific location.
We do not guarantee: Hoerter’s Gander Acres does not guarantee the pets: size, color, temperament, or the ability to reproduce. Seller does not guarantee against ear mites, worms, or bacterial infections at the time of sale or thereafter. Seller warrants that the above described pet has been vet inspected (In accordance to Wisconsin Law Act 90, as required by the Department of Agriculture and Consumer Protection) and is in good health at the time of the sale.
Health: Seller warrants that the above described pet is in good health visually at the time the buyer assumes ownership. Seller does not guarantee against ear mites, worms, parasites, viruses, or bacterial infections or any other “genetic” or “congenital” defects other than against hip dysplasia at the time of scale or thereafter. Buyer will have the pet, mentioned above, neutered or spayed by the time it reaches 12 months of age or this contract and any guarantee will be deemed null or void. (Unless the pet is sold with full registration.)
All Veterinarian expenses for the wellness check, possible life altering genetic defects, yearly exams, or any veterinarian expenses incurred for the pet after 72 hours of assumed ownership while in the buyer’s possession is not the responsibility of the seller. Seller is not responsible for any vet expenses incurred by the pet or the buyer. Seller does not assume any responsibility for the shipping costs if the pet is required to be shipped back into the sellers’ possession.
Health Guarantee: This guarantee is for replacement pets and not for returned money. If a diagnosis of heart murmur should occur before the pet turns 1 year of age, the breeder must be contacted immediately to discuss the issue. If the breeder is not contacted prior to treatment, this contract will be deemed null and void. The buyer is financially responsible for any treatments, medications, and hospitalizations provided by the vet services for the pet. Hoerter’s Gander Acres does not assume any liability for any injury or sickness on the buyer’s property once the pet is in the possession of the buyer. All age appropriate vaccinations and deworming medications have been administered to the pet being sold/purchased.
The buyer agrees to maintain the pet’s health in good condition and or provide yearly examinations, vaccinations, heartworm tests, and any other usual procedures necessary to assure good health of the pet. The buyer agrees to provide suitable areas for this pet to have adequate food, shelter, and to be housed securely.
Hip Guarantee: This hip guarantee is valid until the pet reaches the age of 26 months. For this guarantee to be valid, the pet must not have been bred or have sired a litter. It is understood that this guarantee is for genetic hip dysplasia. This guarantee does not cover any hip Dysplasia caused by poor nutrition/diet or injury. In the event of genetic hip dysplasia that warrants euthanization of the pet before the age of 26 months; Hoerter’s Gander Acres agrees to replace the said pet with a pet of the same quality. All of our adult breeders have been tested and cleared for OFA Hips, OFA Elbows, PRA/PRCD, CNM, and EIC.
Replacement Pet Information: For the replacement pet to be placed, the following terms must be met.
1. Buyer notifies the seller promptly after such a condition is diagnosed (If heart murmur, buyer must contact the breeder before the pet reaches the age of 12 months. If the pet is deemed to have hip dysplasia , the breeder must be contacted prior to the pet reaching 26 months.)
2. A copy of OFA’s refusal must be sent to the seller (If there is a “hip issue”)
3. The pet must not have been bred or sired a litter.
4. The buyer’s must provide the seller with a written statement from a licensed veterinarian stating that the pet was spayed or neutered. 5. Buyer must return the pet to the seller immediately (Providing all transportation and costs incurred to do so.)
If at any time the buyer decides to relinquish ownership of the pet. Hoerter’s Gander Acres must be notified and have the right to first refusal.
By Signing this Contract Agreement, the buyer acknowledges and understands the contents and has entered into
this legal binding contract freely.
